Privacy Policy
This Privacy Policy explains how we collect, use, disclose, and protect personal information when you use Elnez (the "Service"), including app.elnez.com and related sites and apps. By using the Service, you acknowledge this Policy.
1. Scope
This Policy applies to Creators (not limited to editors and clippers), the Elnez team, and visitors who interact with the Service. It does not apply to third-party sites, social platforms, or payment/KYC partners that have their own policies.
2. Information We Collect
You provide directly:
- Account & profile: name, username, email, phone (optional), bio, avatar, and authentication identifiers from social login (Google, Discord).
- Linked social accounts: the handles/usernames you connect (TikTok, Instagram, YouTube, X, Facebook) and verification status.
- Submissions: clip titles, social post URLs, uploaded media/proof, and (if required) demographics screenshots.
- Payout & identity: payout method details (e.g., PayPal), and identity-verification (KYC) information you submit to our verification partner (Didit) such as legal name, date of birth, address, business type, and government ID/biometric data processed by that partner.
- Communications: messages, support requests, chat and forum posts, and survey responses.
Collected automatically:
- Usage & device data: IP address, device/browser type, identifiers, pages viewed, actions taken, timestamps, and referring URLs, via cookies and similar technologies.
- Performance data: views and metrics associated with your submitted clips, retrieved via social platform APIs.
We collect activity information about how you use our Site and Services, for example, the links you click, the searches you run, the features you use, the pages you view, how long you spend, and the files you upload. We also collect service-related activity data such as logs, along with information used to identify where a communication came from and where it's going; to keep the Services and our products performing well; and to monitor, investigate, detect, and prevent fraud, system abuse, security incidents, unauthorized access or activity, and other misuse of the Services.
From third parties: social platforms (when you link an account or log in), payment and KYC partners (verification results, payout status), and analytics/security providers.
3. How We Use Information
We use information to: create and manage your account and authenticate you; run campaigns, review submissions, and calculate and pay rewards; track and verify views and detect fraud, bots, and inauthentic activity; process withdrawals and comply with KYC, tax, and anti-fraud obligations; provide support and send service communications; operate, secure, and improve the Service; and comply with law and enforce our Terms. Where required, our legal bases include performing our contract with you, our legitimate interests, your consent, and legal compliance.
Some of this processing is automated and may use artificial-intelligence tools. Where required by law, you may request human review of a decision made solely by automated means (see Section 6).
4. How We Share Information
We share information with: service providers (hosting, analytics, email, security); payment and KYC partners (Stripe, PayPal, Coinbase, sponsoring bank, Didit) to process payouts and verify identity; social platforms as needed to verify accounts and retrieve view metrics; other users to the extent you post public content (e.g., clips, chat, forum, leaderboards); legal/safety recipients (law enforcement, regulators) where necessary to comply with law, enforce our Terms, or protect rights and safety; and business-transfer counterparties in a merger, acquisition, or financing. We do not sell your personal information for money.
5. Cookies and Analytics
We use cookies and similar technologies for authentication, security, preferences, and analytics. You can control cookies through your browser settings; disabling some may limit functionality.
6. Your Choices and Rights
You can access and update profile information in your settings and opt out of marketing emails. Depending on your location (e.g., EEA/UK under GDPR, or U.S. states such as California under the CCPA/CPRA), you may have rights to access, correct, delete, port, or restrict processing of your personal information, to object, to withdraw consent, and to opt out of "sale"/"sharing" and certain automated decisions, plus a right to appeal. To exercise rights, contact clippings@elnez.com; we will verify your request as required by law.
7. KYC, Payments, and Fraud Data
Identity verification and payment data are processed to meet legal/financial-partner requirements and to prevent fraud. View-pattern and account data are processed to identify bots and inauthentic engagement. Some of this processing is necessary to use payout features; if you decline, you may be unable to withdraw funds.
Identity documents, selfies, and biometric data collected during verification are processed and stored by our verification partner, Didit, acting as our data processor under its own security certifications; Elnez does not store copies of your ID documents or biometric data, only the verification result and a reference to the verification session.
8. Children and Young Creators
We want everyone, teens included, to be able to earn their first dollar online. That cannot come at the cost of safety, privacy, or parental oversight, so accounts held by people under 18 carry additional protections.
Under 13. The Service is not available to anyone under 13, and accounts may not be held by anyone under 13. We do not knowingly collect personal information from children under 13. If we learn that we have, we delete it and close the account.
Ages 13 to 17. During signup we will ask you to tell us your age by providing your date of birth. Accounts belonging to someone aged 13 to 17 will be recorded as minor accounts. Minor accounts will receive additional protections: stricter moderation of content, chat, and direct messages; limited behavioural tracking; and restriction from any campaign we or the campaign owner have marked as age-restricted, for example campaigns involving alcohol, nicotine, or adult themes.
Earning and payouts. A minor account will not be able to receive a payout until a parent or guardian has completed identity verification, told us their relationship to the account holder, and confirmed their consent. Until all three are complete, withdrawal will stay closed. Where a parent or guardian completes verification, we collect and process their identity information as well as the account holder's.
Parents and guardians. If you are the parent or guardian of a user under 18, you may contact us at clippings@elnez.com to review the personal information we hold about your child, request its deletion, or withdraw consent, which will close the account's ability to earn. If you are a California resident under 18, you may request removal of content you posted, under California Business & Professions Code section 22580.
Reporting a concern. If you believe a child under 13 has provided us information, or you have any concern about a minor's safety on the Service, contact clippings@elnez.com. We remove content that is inappropriate for or involves minors, and escalate to our Trust & Safety review. Where there is any indication of grooming, sexual content involving a minor, or predatory behaviour, we preserve the content and metadata for law enforcement, suspend the accounts involved immediately, notify parents or guardians where required by law, and report to the National Center for Missing & Exploited Children (NCMEC) where applicable.
9. International Transfers
We are based in the United States and may process information in other countries that may not provide the same level of protection as your home jurisdiction. Where required, we use appropriate safeguards (such as standard contractual clauses).
10. Security and Retention
We use reasonable administrative, technical, and organizational safeguards to protect personal information, but no method is 100% secure. We retain personal information for as long as needed to provide the Service and to meet legal, tax, accounting, dispute-resolution, and fraud-prevention obligations, then delete or de-identify it.
11. Changes to This Policy
We may update this Policy. We will post changes here and, for material changes, provide additional notice (e.g., by email or in-app). Your continued use after changes take effect constitutes acceptance.
